What’s your system for managing Compliance?

What does compliance have to do with ISO 9001?

The Cambridge English Dictionary defines Compliance as “the act of obeying an order, rule, or request” – adhering to an externally imposed requirement.

The very first section (section 1 – Scope) of ISO 9001:2015 requires organisations to meet applicable statutory and regulatory requirements ie – your company Quality Management System must follow the law.

Managing changes to legislation manually can be time-consuming and inefficient; nearly impossible if you consider that there are over 90,000 amendments per year.

So how does an organisation maintain compliance with legal requirements? How do they keep up to date? There are a number of ways but here are a few options:

Is it Legitimate? How to check if your ISO Certificate is Real or Fake

ISO Certificates should be proof that you have developed and implemented an ISO Management System to meet the requirements of the applicable reference standards. This might include one of the following ISO standards:

  • ISO 9001 Quality Management Systems
  • ISO 45001 Occupational Health & Safety
  • ISO 14001 Environmental Management Systems
  • ISO 50001 Energy Management Systems
  • ISO 55001 Asset Management Systems
  • ISO 17025 Testing & Calibration for Laboratories
  • ISO 27001 Information Security
  • ISO 22000 HACCP Food Safety

But how do you check if the certificate that has been provided is legitimate? There are plenty of shadowy operators in the certification industry so it is important to ensure the Certification Body that you engage to complete the independent, third-party certification audit of your management system is Accredited and your ISO certificate is genuine.

Are there really fake ISO Certificates?

Most definitely yes. A recent report into Fake ISO Certification indicated China leads the world in fake certificates. The report is titled Faking ISO 9001 in China: An exploratory study, and a copy is available by clicking HERE. The report concluded that there were four types of fake certifications as follows:

  1. Counterfeit ISO Certificates – where the organisation uses photoshop or other image editing software to create a completely fake certificate.
  2. Unaccredited ISO Certificates – where an unaccredited third party completes an audit and provides a certificate (this is the most common type of fake certificate in Australia – see HERE for more information).
  3. Paperworked ISO – where a company has used another organisations management system to achieve certification.
  4. Implemented but not in use ISO system – where an organisation has developed an ISO system but it has not been implemented so has no bearing on the business operations.

How to check if your ISO Certificate is Legitimate

In the past, you would need to check the accreditation body or certification body register to see whether the ISO certificate was legitimate. This was often impossible as the accreditation bodies and certification bodies didn’t always publish a register.

In order to try and stem the proliferation of fake certificates, the International Accreditation Forum (IAF) has now published a global database for accredited management system certifications called CERT Search.

To use the search function simply CLICK HERE and then enter the “Company Name” or “Certificate Number” and the results will allow you to verify the status of a certificate.

What to do if you find you have a fake ISO Certificate

If your search indicates that you or one of your suppliers have a fake certificate then you need to establish:

  1. Was anyone aware that the certificate/system was fake?
  2. What needs to be done to transfer your certification to an Accredited Certification Body?
  3. Does the management system conform with the requirements of the QMS standard?

If you were not aware that the certificate was a fake then contact the company that issued the certificate. Confirm the situation and then attempt to come to some resolution. We have heard of many situations whereby the threat of legal action achieves a refund however the majority of times it simply comes down to a costly lesson learned.

You can also contact ISO directly and report the sitaution. ISO takes very seriously any complaint related to the misuse of the ISO logo or false certification to ISO management system standards.

If you wish to report an organization that is falsely claiming to be certified to an ISO management system standard, you can send an email [email protected] with full details of the issue.

According to the ISO website, they will contact you within 14 days. Note that ISO cannot guarantee a resolution or assume any liability, but they can help to facilitate dialogue between the parties involved and work towards a positive outcome.

In order to transfer certification to an accredited Certification Body then I recommend you contact one of the certification bodies listed on this page HERE. Explain the situation and they will need to obtain a copy of your latest audit report (if the dodgy company provided you with one). Keep in mind that if you had a fake certificate then it is likely your management system has significant deficiencies; in which case you may need to engage an ISO Consultant to help close the gaps.

Fast ISO 9001 Certification in 10 Days – Is it Possible?

Possible? YES – Fast ISO 9001 Certification is possible. We know because we have done it by working with clients that have tight timeframes (eg tenders due) to get them certified in 10 days – including the Stage 1 and Stage 2 certification audit from a JAS-ANZ Accredited Certification Body.

Conditional? YES definitely. That’s right, there are some key conditions required to make a fast ISO 9001 certification a possibility in ten days. Read on for more information.

Conditions required for fast ISO 9001 Certification

As little as 10 days.

How to Get Fast ISO 9001 Certification

  1. Processes must be relatively straight forward – not excessively complicated.

    Complicated processes take more time.

  2. The Senior Leadership Team must be totally committed to customer focus, Quality Management, achieving certification and continual improvement of the business.

  3. The company must be a relatively small business.

    Preferably less than 20 employees.

  4. The business should only operate from a single location.

    A ten-day timeframe for a National company with multiple locations wouldn’t be possible.

  5. Unrestricted access to all personnel.

    This must be provided to the Quality Assurance Consultant to allow them to walk the Gemba, develop, review and implement the QMS without interruption or delays.

  6. Employees must respond in a timely manner to any requests for information the ISO 9001 Consultant may have.

    This may include review and approval of documentation, and updating of applicable registers/documentation with information eg Training and Competency Register, Equipment Test & Calibration Registers etc.

  7. The Certification Body will have to do a back to back audit which means the Stage 1 and Stage 2 ISO 9001 audit consecutively.

    To do this, the Certification Body will need to have full confidence in the ISO Consultant’s ability to design the management system to meet the requirements of both the business and ISO 9001 without Non-conformities.   8. Certification Body auditor availability

    The CB will need to have an auditor available at short notice that can carry out the audit of the management system to meet the requirements of ISO 19011:2018 Guidelines for auditing management systems

  9. The ISO 9001 Consultant may have to work after hours / over weekends to ensure:

    Documentation is developed to requirements,
    Internal audit reporting is completed, and action items are addressed accordingly,
    QMS Management Review meetings are completed and minuted per requirements. Fast ISO Certification

The Ultimate Guide to ISO 9001 Audits

Achieving a good result at an ISO 9001 Audit should be a walk in the park for a well designed, developed and implemented Quality Management System. During the audit, the Certification Auditor will sight objective evidence to support conformity with each of the sub-clauses (clause numbers 4-10) of ISO 9001. This will mean an ISO 9001 audit result of either:

  1. Satisfactory – all is well
    Internal Auditing
  2. Improvement Opportunity – the auditor is recommending improvements (take them or leave them)
  3. Observation – things may be going off the tracks
  4. Minor Non-conformity – isolated minor deficiency identified
  5. Major Non-conformity – major deficiency identified

Note: If you have received a dreaded ISO 9001 Quality Management System major non-conformity it means there has been a significant deficiency identified in the structure and/or the implementation of the quality management system but don’t panic! Read on. 

What is the difference between a non-conformity and a non-compliance?

Before we go into the details of the various audit codes it is worth reflecting on the terminology used (incorrectly at times) around ISO Audits.

  • A Non-compliance is typically used when there is a breach of externally imposed requirements, for example, when you have not complied with the law (Acts, Regulations, etc) – Noncompliance.
  • A Non-conformity (also known as a Non-conformance) is normally used in situations where there has been a failure or non-fulfillment to conform with internally imposed requirements such as ISO Standards (eg ISO 9001 Quality Management Systems).

So when talking about ISO Audits you would normally say audit Non-conformity as opposed to audit Non-compliance. On the flip side (where you want to be), you would conform with ISO standards and comply with legal requirements.

ISO 9001 Audit Codes

A note about ISO Audit codes: Under JAS-ANZ, Certification Bodies are not obliged to use specific Audit Codes so these may vary somewhat depending upon which Certification Body conducts the audit. For example (with reference to the definitions below), some Certification Bodies will raise an Improvement Opportunity as their Observation, a Minor Non-conformity as an Improvement Request, and a Major Non-conformity as a Non-conformity. So much for standardisation! That said the following definitions will largely apply.

Satisfactory

Satisfactory (SAT) objective evidence was sighted to demonstrate conformance with ISO 9001:2015 Quality Management Systems. No further action required here – keep up the good work and well done!

Improvement opportunity

If the ISO Certification auditor identifies an Improvement Opportunity (IO) then it means they think things could be done better and they are making a recommendation to try and add value to your Quality Management System through their audit service. Bear in mind that there are many ways to skin a cat and some ISO 9001 Certification auditors may be used to seeing systems set up in a way that may not necessarily be the best solution for your business. You aren’t required to action IO recommendations made in the audit report however it is a good idea to address them in either the Improvement Register or QMS Management Review Minutes, even if it is just to say that you have reviewed the recommendations and aren’t going to proceed with them.

Observation

If the Auditor gives you an Observation (OBS) it means that things aren’t going to plan and there are some issues that need addressing before they escalate to a Minor or Major Nonconformity. Observations should be registered in your improvement framework and action taken to address the recommendations made prior to the next surveillance audit from the Certification Body.

Minor nonconformity

An isolated failure to conform with the requirements of the ISO standard or implement the Quality Management System is generally classified as a minor nonconformity and as a minimum should be addressed within the next 12 months prior to the next surveillance audit.

A Corrective Action Plan is not usually required as long as the non-conformity is registered into the improvement framework and addressed in a timely manner (maximum of 12 months). Corrective action taken to address a Minor Non-conformity will be reviewed at the following surveillance audit and if appropriate action has not been taken then the Minor will likely escalate into a major Non-conformity.

Major nonconformity

A Major Non-conformity means the auditor has determined that there is a complete or significant absence of any objective evidence to support conformance to the clause, or a complete failure to implement the Quality Management System to requirements.

If you receive a Major Nonconformity then you will not receive certification (if it is your initial audit) until the Non-conformity has been closed out, and if you are already certified then the Certification Body will not renew your certification if the Non-conformity has not been actioned within three months (ie certification suspended). But again – don’t panic!

When a Major Nonconformity is raised, simply complete the following five steps:

  1. Complete a Corrective Action Plan (including Root Cause Analysis).
  2. Submit the Corrective Action Plan to the Certification Body for review and approval within one month of the audit date.
  3. Action the items detailed in the Corrective Action Plan within three months.
  4. Update the Corrective Action Plan when the action items have been completed to indicate they have been closed out.
  5. Send the completed CAP to the Certification Body, along with any other evidence required to support the completion of the action items.

Based on the information provided the Certification Body may decide a follow-up audit is required to verify the effectiveness of action taken.
